Drawing the limits between Peril of the Sea and Act of God

Peril of the Sea and Act of God are both well known but broadly defined maritime terms. Many definitions have been elaborated by different jurists in different times. There is nevertheless no precise, unequivocal explanation to what is “Peril of the Sea” and what is “Act of God”. Nonetheless their role is essential in contracts of carriage while they are incorporated into the Hague-Visby Rules art. 4(2)(c) and art. 4(2)(d) respectively as well as their importance in marine insurance is absolutely evident. This paper only considers the role of the exceptions in the contracts of carriage context.-
